Same-sex cohabiting couples will now be assessed for means-tested benefits as if they were living together as civil partners, just as mixed-sex cohabiting partners are assessed together as if they were living together as a married couple.

If you’re in a civil partnership when you claim income related benefits, such as income support, housing benefit or pension credit, you will be treated as a couple and jointly assessed. After 5th December 2005, the same will apply to all cohabiting same-sex couples. This may not be to the advantage of all couples, for example if one of you works full-time and the other is unemployed.

If you’re claiming a benefit with an increase for an adult dependant, such as incapacity benefit, you or your partner may be considered eligible for this, depending on their circumstances, whether or not you have a civil partnership.
